Modified Query - Whether period of training qualifies as regular service?
Original Query - I am working as Postal Assistant in Department of Posts. I want to appear departmental examination of Inspector of Post which is to be held in Sept-2012. The eligibility criteria is 5 years regular service in PA cadre as on 30.06.12. My date of entry in department is 12.07.2007. i.e. training period 12.07.2007 to 29.10.2007. My query is whether training period counts towards regular service? whether i am eligible for Inspector of Post exam which to be held in Swewpt-2012?

Reply - The issue of qualifying service has been dealt under Rule 13 of the CCS (Pension) Rules, 1972 which stipulates that qualifying service of a central government employee shall commence from the date he takes charge of the post to which he is first appointed either substantially or in an officiating or temporary capacity. Further, Rule 15 provides that service on probation against a post if followed by confirmation in the same or another post shall also qualify as regular service.
Accordingly, your qualifying service commences from your date of joining, i.e. 12/07/2007 and the period of training qualifies as regular service. However, you are still not eligible (unless specifically considered by the Head) as you are just short of 11 days for 5 years service as on 30/06/2012. It may be noted that rounding of qualifying service is NOT applicable in such cases.
Query - If after probation, a confirmation letter is not received from the employer, even after passing two or more years, will a central government employee be treated as confirmed ? (Mr. Kuldip Kumar, Indian Army)
Reply - The issue of period of probation in central government services and confirmation thereafter has been dealt in the Ministry of Home Affairs OM No. 44/1/59-Essts., dated 15/04/1959, which, inter alia, stipulates the following:-
On expiry of the period of probation, steps should be taken to obtain the assessment reports of the employee and based on the report either to confirm, or to extend probation or terminate the service of the employee. Such a communication (whatever the case may be) to the employee should be made normally within 6 – 8 weeks after completion of the probation period.
It further stipulates that confirmation is not automatic but is to be followed by formal orders and as long as no such order is made, the employee is deemed to have continued on probation.
